Rental Agreement

1. AGENT & REPRESENTATION

Customer may assign an Agent over the age of 18 to act for the Customer to receive, oversee setup, or approve breakdown of Equipment. Customer agrees to notify Trippy Boom Productions, LLC (“TB”) in writing/email when assigning an Agent. Use of an Agent does not limit Customer responsibilities under this Agreement in any way.

2. PAYMENT & DEPOSIT TERMS

TB standard policy is to reserve Equipment by charging a non-refundable deposit of 50% of the Job total. Outstanding balances must be paid in full no later than three (3) days prior to the Start Date. Outstanding balances arising from extended rental time, damaged Equipment, or additional Labor will be charged to the Customer credit card on file. Customer agrees to pay all court costs and attorney fees related to unpaid balances.

3. CANCELLATIONS

Orders cancelled more than 14 days before the Start Date forfeit the 50% deposit. Cancellations made within 7 days of the Start Date are subject to a 100% charge of the total contract price. Cancellations due to acts of God (weather, etc.) will be charged only actual costs incurred if the Job is rescheduled within 3 months.

4. DELIVERY, SETUP, & PICKUP

TB delivers and sets up all lighting, music, and AV equipment, and performs all breakdown and pickup tasks. Customer is responsible for TB’s safe and open access to the Job location. Redelivery or repickup due to Customer or Venue interference is subject to additional charges. TB technicians are the only personnel authorized to handle or move the equipment.

5. VENUE, ELECTRICAL, & SAFETY

The Customer is exclusively responsible for ensuring the venue provides adequate and safe electrical outlets and circuits as specified by TB. If the Customer is renting a facility, the Customer is responsible for all damages to that property, and for the security and safety of TB technicians and equipment. TB takes no liability whatsoever for venue-imposed fines or property damage.

6. DAMAGED EQUIPMENT & CREDIT CARD AUTHORIZATION

Customer is responsible for all damage to Equipment from any cause whatsoever incurred while in possession of Equipment, including damages caused by event attendees. Customer explicitly authorizes TB to charge the credit card on file for the full replacement MSRP or repair costs of any damaged or missing items.

7. INDEMNIFICATION & LIABILITY

Customer agrees to indemnify and hold harmless Trippy Boom Productions, LLC for damages and liability to rented items, persons, and property. Customer assumes all risk of injuries or wrongful death resulting from the event environment. TB takes no liability for venue power failures, facility rental disputes, or third-party claims.

8. GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes shall be resolved in the courts of Harris County, Texas.
